By using this website and available services, whether or not you sign up as a member, you signify your agreement to these terms of use. We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms at any time without notice upon each member. Please check these terms periodically for changes. Your continued use of HEYEV.COM services following the posting of changes to these terms will mean you accept those changes.

A user as referred to in this document is a participant with a valid username and password for the site during the terms of the service. All information provided by a user must be accurate. A user may not post any item that is inappropriate including spam or that may violate any laws of the United States for example, viruses, ponzi or pyramid schemes. All users must be the age of 18 years or older to have the capacity to enter into a legally binding contract.

Access to and use of our services is through a combination of a username and a password. You must keep your password strictly confidential. Sharing of account passwords with other persons is a violation of this agreement and may result in account termination.

If you become an user, you may list items and bid on items for free. We reserve the right to change the amount of, or basis for determining, any fees or charges for services we provide, and to institute new charges or terms effective upon prior notice to customers.

Any posting of content in the website grants us a non-exclusive, irrevocable, right to exercise the copyright, publicity, and database rights you have in the content.

At any time, and without cause, a user may be terminated for failure to deliver items purchased or traded by you or for failure to deliver payments for items you may have purchased or traded.

You will not hold HEYEV.COM responsible for another users actions or inactions, including items or things they post. Furthermore, I release and indemnify HEYEV.COM, its officers and employees, from any claims, liability, losses, costs, damages, or expenses (including attorney's fees) arising from my use of or participation in this service or the information contained therein. The services we provide do not involve us in the actual transaction between buyers and sellers. We do not guarantee the quality, safety, accuracy or legality of any listing, or the backround of any seller or buyer using this system.

We do not transfer the legal ownership of items from the seller to the buyer, and nothing in this agreement shall modify the governing provisions of Uniform Commercial Code § 2-401(2), under which legal ownership of an item is transferred upon physical delivery of the item to the buyer by the seller. Unless the buyer and the seller agree otherwise, the buyer will become the item's lawful owner upon physical receipt of the item from the seller, in accordance with Uniform Commercial Code § 2-401(2).

These Terms of Service and our Privacy Policy and Agreement shall be interpreted in accordance with the laws of United States. Customer acknowledges that, notwithstanding the use of United States law for purposes of interpreting these Terms of Service, and, except with regard to United States citizens or residents, no substantive right or remedy under United States law, including the consumer protection laws of United States, shall be available to you as a basis for any action, claim or other proceeding against HEYEV.COM, and you hereby waive any such rights. In any action arising under these Terms of Service, you consent to the jurisdiction and venue of the courts of United States.
